By accessing our website sigma explorer, its services and any webpage thereof ("Portal"), you or you as an employee acting on behalf of your company ("You") agree to be bound by these Additional Terms, (2) Swiss Re's Terms of Use, and (3) Privacy Policy to comply with any applicable laws and regulations.
If you do not agree to these terms, do not proceed to further pages of the Portal.
AI Chatbot
1.1. Certain features and functionalities within the Portal, e.g., ask sigma, may include artificial intelligence ("AI Chatbot"). AI Chatbot may not be available or accessible to all users and access is granted at our sole discretion. Any output generated by AI Chatbot ("Output") is for informational purposes only and does not constitute reinsurance, insurance, medical, professional, legal or other professional advice. You are solely responsible for conducting your compliance assessments and ensuring that your use of AI Chatbot and Output complies with all applicable laws and regulations.
1.2. You may provide input to the AI Chatbot and receive Output. As between the parties, you own the input and we own the Output, to the extent any rights can be claimed in the Output. Subject to these Additional Terms, we grant you a non-exclusive, non-transferable, revocable, and limited license to use the Output generated by the AI Chatbot solely for your internal business purposes. You may provide input that is similar or identical to a third party’s user’s input or may receive Output that is similar or identical to Output provided to other third-party users. Queries that are requested by other third-party users and responses provided to other third-party users are not your input or/and Output.
1.3. The AI Chatbot and Output may contain inaccuracies, errors, or omissions and should always be independently verified by qualified professionals. We disclaim all liability arising from reliance on the AI Chatbot or Output.
1.4. You are solely responsible for how you use, train users on AI and prompt the AI Chatbot, including ensuring compliance with applicable laws and regulations and the Microsoft Enterprise AI Services Code of Conduct (https://learn.microsoft.com/en-us/legal/ai-code-of-conduct). You agree not to use the AI Chatbot to input sensitive, personal, or legally protected data; any unlawful, invasive, infringing, defamatory or fraudulent purpose. We disclaim any liability for misuse or improper reliance on AI-generated Output.
1.5. You are responsible for protecting your account from unauthorized access by keeping account login information, including user names and passwords, strictly confidential, and not to provide such account login information to any unauthorized parties; if you become aware that the security of your account login information has been compromised, immediately inform Swiss Re.Restrictions
2.1. You agree you will not (and shall not allow anyone to) access, store, distribute or transmit any viruses or any material during your use of the Portal or send, receive, upload, download, store, use, distribute or publish any material that is offensive, abusive, indecent, defamatory, obscene, spam or in breach of any other person's intellectual property rights. You will not use the Portal for any unlawful, unethical, harmful, defamatory, obscene, infringing, or unauthorized purpose.
2.2. We grant you a non-exclusive, non-transferable, revocable right to access the Portal strictly in accordance with these Additional Terms, the Terms of Use and the Privacy Policy. You will use the Portal solely for legitimate business purposes and in accordance with the Terms of Use and the Additional Terms.
2.3. You will not (and shall not allow anyone to):
2.3.1. attempt to copy, duplicate, modify, adapt, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any portion of the Portal in any form or media or by any means; or
2.3.2. attempt to reverse compile, decompile, disassemble, reverse engineer, or otherwise reduce to human-perceivable form all or any part of the Portal or any underlying models or systems; attempt automated means to scrape content or Output and/or to train or develop another model with the content or Output; or remove or attempt to remove any copyright or attribution notices on the Portal or a copy thereof or any downloaded or printed materials from the Portal.
2.4. You will not (and shall not allow anyone to) use the Portal on behalf of or for the benefit of any third party; or for the purpose of developing or improving a similar or competing product or service.
2.5. The Portal may include features or versions that are labeled as alpha, beta, experimental, pilot, limited release, in development, developer preview, early access, non-production, evaluation, or similar terms (collectively, "Beta Services"). Beta Services are intended for evaluation purposes only and not for production use, are not supported, and may be subject to additional terms or charges. Swiss Re may charge fees or modify or discontinue the Beta Services at any time without notice or obligation.Intellectual Property
3.1. Swiss Re and its licensors retain ownership of all Intellectual Property Rights in the Portal and its contents, including any modifications, all Outputs, or derivatives thereof. You are granted no rights other than those explicitly outlined in these Additional Terms.
3.2. You hereby assign to Swiss Re any intellectual property developed in relation to the Portal that arises from your questions, prompts, requests, suggestions, or ideas (“Feedback”), regardless of whether such newly developed intellectual property result from software-related services paid for by you. These Additional Terms do not prevent Swiss Re from independently developing its own content, products and services.
3.3. Your intellectual property and its derivatives remain your property ("User's Content"). You grant to Swiss Re a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to: (a) utilize User's Content to provide all services under the Portal and perform its obligations under these Additional Terms; (bb) combine anonymized User's Content (and other information derived from User’s use of the Portal) with similar information from other customers to improve and deliver services; and (cc) transmit the User's Content to third-party providers, applications and services required for Portal.
3.4. Swiss Re respects intellectual property rights and expects you to do the same. Infringement notices can be sent to:

4.1. From certain areas of the Portal, you may be able to access websites or materials operated by third parties via links, search engine functionality (e.g., Google), RSS feeds, or other public tools (“External Websites and Materials”). These External Websites and Materials are not hosted, monitored, or controlled by Swiss Re, and Swiss Re does not endorse or assume responsibility for their content, accuracy, or availability. Access and use of External Websites and Materials is at your own risk. Swiss Re shall not be liable for any loss or damage arising from your use of, or reliance on, content obtained through External Websites and Materials, including documents, data, or other information. Where the Portal uses or references publicly available data provided under open-source data licenses or open terms, appropriate attribution is provided in accordance with the respective data providers’ requirements. 5.1. Our Privacy Policy is available on each Swiss Re Site. You understand that your use of a Portal will result in our processing of personal data that you provide. The Privacy Policy sets out the basis on which we will use personal data. By using a Portal, you are deemed to agree with the terms of the Privacy Policy. In fulfilling your obligations under these Additional Terms, you commit to comply with applicable data protection laws.General Provisions
6.1. If a provision of these Additional Terms is or becomes illegal, invalid or unenforceable in any country, that will not affect the legality, validity or enforceability in that country of any other provision or in other jurisdictions of that or any other provisions of these Additional Terms.
6.2. Swiss Re websites are generally governed by terms, conditions, disclosures or disclaimers (“Terms of Use”) published here: Terms of Use. In the event of a conflict between these Terms of Use and the Additional Terms, the Additional Terms will govern Portal services and its content.
6.3. Swiss Re's rights under these Additional Terms may be exercised as often as necessary. They are cumulative and not exclusive of rights or remedies provided by law, rules and regulations. They may be waived only in writing and specifically. Delay in the exercise or non-exercise of any such right is not a waiver of that right. An express or implied waiver of any of the provisions or of any breach of or default in performing any of the provisions of these Additional Terms will not constitute a continuing waiver and that waiver will not prevent the waiving party from subsequently enforcing any of the provisions of these Additional Terms not waived or from acting on any subsequent breach of or default by the other party under any of the provisions of these Additional Terms.
6.4. Any notice or other communication given under or in connection with these Additional Terms will be in English. All other documents provided under or in connection with these Additional Terms will be in English. A document in another language must be accompanied by a certified English translation. In such a situation the English translation will prevail, unless the document is a statutory or other official document.Termination
7.1. We reserve the right to update these terms at any time without prior notice. You are required to periodically confirming your acceptance of any changes and acknowledge your compliance responsibilities. 7.2. We reserve the right to terminate the Additional Terms at any time and to modify, suspend or discontinue, temporarily or permanently, the Portal or any Beta Services with or without notice and without liability to you.
7.3. Any provisions which, by their nature should survive termination, should remain in effect after termination, including, without limitation, those related to intellectual property, disclaimers and limitations of liability.Liability
8.1. Whilst we have used all reasonable care and skill in collecting and preparing the information, documents and other materials or functionalities provided or available in the Portal. Notwithstanding this, the Portal (including the information, documents and other materials or functionalities provided or available in Portal) are provided on an “as is” and “as available” basis, without any warranty of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, reliability, error-freeness, fitness for a particular purposes, title or non-infringement of intellectual property rights and availability.
8.2. You acknowledge that the Portal and the materials contained therein are of an advisory informational nature only and that, in relation to the Portal, it is your responsibility to evaluate and decide whether to assume any risk associated with using the Portal, and, if so, on what terms. In using the Portal, you agree to comply with all applicable laws and regulations, including but not limited to anti-discrimination laws and competition / anti-trust laws.
8.3. The use of the Portal is entirely at your own risk and expense. Swiss Re shall not be responsible for any damages, losses, or costs arising from the Portal. To the fullest extent permitted by applicable law, we disclaim all liability arising out of or in connection with the Portal or any Output, whether direct, indirect, incidental, special, consequential, or otherwise.
8.4. You shall fully indemnify, defend and hold us harmless against any claims, actions, proceedings, losses, damages, expenses and costs (including court costs and reasonable legal fees) arising out of or in connection with your use of the Portal, including any failure to conduct compliance assessments or ensure compliance with applicable laws and regulations or in the event of unauthorised access by your employees, agents or contractors (or former employees, agents or contractors) or any unauthorised access caused by your acts or omissions.Governing Law / Place of Jurisdiction
9.1. These Additional Terms shall be governed by and interpreted in accordance with Swiss law without giving effect to the conflicts of law provisions thereof and excluding the United Nations' Convention on the Contracts for the International Sale of Goods and we and you each submit irrevocably to the exclusive jurisdiction of the competent courts of Zurich, Switzerland.- Contact
10.1. If you have any questions relating to these Additional Terms, please contact us using the general contact functionality provided on any Portal site.
10.2. If you subscribe to Portal, provide comments or otherwise communicate with Swiss Re through a Swiss Re or e-mails provided on a Swiss Re, you may be requested to provide your contact details, particularly your e-mail address. By providing your contact details you expressly agree that Swiss Re retains your contact information and may contact you, in particular for the following reasons: requesting clarifications or additional comments; sending Swiss Re publications; sending information about Swiss Re events; asking for your participation in surveys or polls; sending information about services and solutions or other marketing information of Swiss Re. However, Swiss Re will not send out mass unsolicited e-mails or mails without your prior approval.
10.3. You may when first contacting Swiss Re or at any time thereafter inform Swiss Re that you would rather not receive any information or certain information (e.g. promotion material) from Swiss Re. You may inform Swiss Re through the general contact functionality provided on any Portal.
